Terms of Service

1. Eligibility & Account Registration

You must be at least 18 years old to use the Service. By registering, you confirm that the information you provide is accurate and that you have authority to connect any social media accounts or workspaces you add. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

Auto Presence AI is available globally, except where prohibited by applicable law, sanctions, or export control regulations, including but not limited to Israel. You represent that you are not located in, and will not access the Service from, a restricted region, and are not on any government restricted-party list.

2. Description of Service

Auto Presence AI provides AI-powered social media automation, AI content generation, SEO content tools, and related publishing features across supported platforms. Features, supported platforms, and AI providers available to your account depend on your subscription plan and may change over time as described in Section 15.

3. Subscriptions, Credits & Billing

Certain features require a paid subscription. Subscription plans, pricing, included credits, and feature limits are described on our pricing page and may be updated from time to time; continued use of the Service after a pricing change takes effect constitutes acceptance of the new pricing for future billing periods.

The Service operates on a credit system: certain actions (content generation, image generation, publishing, and similar) consume credits allocated to your plan. Unused credits do not necessarily carry over between billing periods unless stated otherwise at time of purchase. Additional credits may be purchased separately as top-up packs.

Subscriptions renew automatically each billing period unless canceled before the renewal date. You can cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period.

4. Refund Policy

Refund requests may be submitted within 7 days of the original payment date. Refund requests for amounts under $50 are reviewed and decided by our billing team; requests for $50 or more are reviewed by senior management. Approved refunds are processed to the original payment method. Credits already consumed at the time of a refund request may be deducted from the refunded amount at our discretion. This policy does not affect any non-waivable statutory refund rights you may have under the law of your jurisdiction.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or the terms of service of any connected third-party platform (social media networks, WordPress, AI providers)
• Generate or distribute content that is illegal, defamatory, harassing, hateful, sexually explicit involving minors, or infringes on the intellectual property or privacy rights of others
• Distribute malware, spam, or engage in coordinated inauthentic behavior on connected platforms
• Attempt to circumvent credit limits, plan restrictions, or security measures of the Service
• Reverse-engineer, resell, or white-label the Service beyond what your plan explicitly permits

We reserve the right to suspend or terminate accounts that violate this section.

6. Your Content & Intellectual Property

You retain ownership of content you upload to the Service. By using the Service, you grant us a limited license to process, store, and publish that content solely as necessary to provide the Service to you (e.g., posting to platforms you've connected). We do not claim ownership of your content.

The Service itself, including its software, design, and branding, is owned by Auto Presence AI and protected by applicable intellectual property laws.

7. AI-Generated Content

Content generated using AI features is produced by third-party AI models based on your prompts and settings. You are responsible for reviewing AI-generated content before publishing it, and for ensuring it complies with applicable law and the policies of any platform you publish to. AI output may occasionally be inaccurate, and we do not guarantee the accuracy, originality, or fitness for any particular purpose of AI-generated content.

8. Third-Party Social Media Platforms

Connecting and publishing to third-party platforms (such as Facebook, Instagram, LinkedIn, YouTube, Pinterest, Twitter/X, Threads, or Telegram) is subject to that platform's own terms of service and API policies, which may change independently of this Service. We are not responsible for changes, restrictions, or account actions imposed by third-party platforms.

9. Bring Your Own API Key (BYOK)

Certain plans allow you to use your own API keys for AI providers. If you use this feature, you are solely responsible for costs, quota, and compliance with that provider's own terms; we are not responsible for charges incurred directly with your AI provider.

10. Suspension & Termination

We may suspend or terminate your account for violation of these Terms, non-payment, suspected fraud, or as required by law. You may terminate your account at any time. Upon termination, your right to use the Service ends, though certain provisions of these Terms (billing obligations, intellectual property, disclaimers, liability limits) survive termination.

11. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation, or any particular results from using the Service (including social media growth, SEO ranking, or engagement outcomes).

12. Limitation of Liability

To the maximum extent permitted by law, Auto Presence AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service shall not exceed the amount you paid us in the 3 months preceding the claim.

13. Indemnification

You agree to indemnify and hold Auto Presence AI harmless from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms or applicable law.

14. Governing Law

These Terms are governed by the laws of [JURISDICTION — TO BE CONFIRMED], without regard to its conflict of law principles, except where mandatory consumer protection law of your own country of residence provides otherwise.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above, and where appropriate, by additional notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
